Workshop T&Cs

1. PREAMBLE

These general conditions of sale for the website www.secretgardenglass.fr are concluded between the customer, an adult  person, and Julie Johnson, individual entrepreneur, SIRET identifier 409 721 404 0062.

2. DEFINITIONS

“CGV”: General conditions of sale of Secret Garden Glass, the individual company of JULIE JOHNSON.

“Customer”: Refers to the non-commercial person, aged at least fifteen (15) to join the workshops.  The Customer uses the equipment provided under his own responsibility and is required to follow the recommendations of Julie Johnson/Secret Garden Glass when using them.

The Customer is clearly informed that the handling of the equipment may be subject to certain precautions and is aware of the importance of handling the tools correctly as well as properly following the instructions. He is required to ensure his own responsibility and that of other participants.

3. SCOPE OF APPLICATION

Julie Johnson reserves the right to modify or adapt these General Terms and Conditions at any time and without notice.

By purchasing an introduction to glassblowing on the Secret Garden Glass website, you accept the General Terms and Conditions in force. 

4. AVAILABILITY OF INTRODUCTION WORKSHOPS

The offers for introductory workshops are valid as long as the introductory workshops are visible on the Website, subject to availability.

5. SPECIAL PROVISIONS FOR WORSHOPS

The Introductory workshops are workshops carried out with several participants within Julie Johnson's SECRET GARDEN GLASS workshop. 

The content  of the introductory workshop is explained in the description on the website.  The content of the Introductory workshop  is freely decided and adapted by Julie Johnson.

In the event that the Client makes a reservation for an introductory workshop that is already full, a new date for the introductory workshop will be offered.

Reserving an introductory workshop online (with or without an effective date at the time of purchase) entitles you to a gift voucher valid for twelve (12) months from the date of purchase. Julie Johnson/Secret Garden Glass does not provide refunds on these gift vouchers, except in cases of force majeure left to the discretion of Julie Johnson/Secret Garden Glass. A gift voucher can be converted into a credit of equivalent value, valid on all items and services offered by Secret Garden Glass.

An email specifying the terms and conditions of the introductory workshop is sent to the client in the days preceding the workshop, followed by an SMS the day before to indicate the precise directions to find the workshop and a reminder concerning clothing advice for the workshop.

Objects made during the workshop must be collected within two months following the workshop date. If it is impossible to pick them up, Secret Garden Glass can prepare and send the package, at the customer's expense. Secret Garden Glass is not responsible for damage occurring during the sending of creations made during the workshop.

6. CANCELLATIONS

Julie Johnson reserves the right to freely postpone the introductory workshop for the following reasons:

  • number of registrants less than the set minimum -2 
  • technical problems with the ovens/equipment, which prevent the operation of the workshop. 
  • health or epidemic context preventing or recommending against the holding of gatherings or the organization of events; 
  • Julie Johnson's health problem. 

In these four hypotheses, Julie Johnson will offer the Client a new date for the Initiation workshop. The Client will be free to cancel or not their participation on the proposed new date. The price can therefore be used as credit for a new Introductory workshop subject to having informed Julie Johnson seventy-two hours (72) before the date of the proposed Initiation workshop.

If Julie Johnson cancels the Introductory workshop outside of these hypotheses, the sale may be cancelled at the written request of the Customer under the conditions provided for in articles L. 216-2, L. 216-3 and L. 241-4 of the Consumer Code. The amounts paid by the Customer will then be returned to them no later than thirty (30) days following the date of termination of the contract.

If the Client is unable to attend the Introductory workshop, he or she may freely postpone or cancel his or her participation by respecting a notice period of seven days before the start date of the Initiation workshop. Julie Johnson is free to refuse the postponement or cancellation of the Introductory workshop if the notice period is not respected. If the notice period is less than one week, no reimbursement can be made, except for duly justified medical reasons.

7. PRICES

The prices of introductory workshops are indicated on each workshop sheet in euros. 

Julie Johnson/Secret Garden Glass reserves the right to modify the prices of the Introductory workshops at any time, but the Introductory workshops will be invoiced on the basis of the prices in force at the time of validation of the Order by the Customer on the Website.

The price of the introductory workshop is payable in full and in a single payment when ordering online.

8. RESPONSIBILITY

Each of the Parties undertakes to comply with its obligations under the Contract.

Julie Johnson/Secret Garden Glass shall not be held liable in the event that the non-performance or improper performance of an obligation is attributable to an event of force majeure within the meaning of article 1218 of the French Civil Code and case law, or to the fault of the Customer or a third party.

Julie Johnson/Secret Garden Glass may only be held liable for events directly attributable to it, which excludes compensation for any indirect loss of any nature whatsoever, in particular operating losses or loss of profit.

Julie Johnson/Secret Garden Glass shall not be held liable for damages of any kind, whether material or immaterial, direct or indirect, which may result from improper use, adaptation or modification of the Products by the Customer alone.

Julie Johnson/Secret Garden Glass shall not be held liable for any damage resulting from the defectiveness of the Customer's equipment or objects.

Julie Johnson/Secret Garden Glass declares that it holds insurance policies covering its professional civil liability with a solvent company.

Julie Johnson/Secret Garden Glass cannot be held liable for any personal injury or material damage suffered before, during or after the Introductory Course, or during travel related to the Introductory Course, except in the case of gross negligence.

All participants in the Introductory Course are required to have insurance covering any damage they may cause to others or to equipment. They may be held liable for any damage caused by their own actions.

The customer uses the equipment supplied under his/her own responsibility and is required to follow the recommendations of Julie Johnson/Secret Garden Glass when using them. 

The Customer is clearly informed that the handling of the equipment may be subject to certain precautions and is aware of the importance of handling the tools correctly and following the instructions. He/she is responsible for his/her own safety and that of other participants.

The Customer must also inform Julie Johnson/Secret Garden Glass of any health problems that may make the handling of certain materials or products used for the Introductory Course incompatible.

Julie Johnson/Secret Garden Glass will adapt the Introductory Course to the points raised as far as possible.
